Description of Service

DigiProgress is a visual workflow builder platform powered by LangFlow. We provide hosted infrastructure for creating, managing, and deploying AI-powered workflows without the need to maintain your own servers or infrastructure.

Our service includes:

• Visual workflow builder interface
• Integration with various LLM providers (OpenAI, Anthropic, etc.)
• Workflow hosting and execution
• API access to your workflows
• Storage for your workflow configurations and data

Account Registration

To use DigiProgress, you must create an account. You agree to:

• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account
• Not share your account with others

We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.

Acceptable Use Policy

You agree not to use DigiProgress for any unlawful or prohibited purposes, including but not limited to:

• Violating any applicable laws or regulations
• Infringing on intellectual property rights
• Transmitting malware, viruses, or harmful code
• Attempting to gain unauthorized access to our systems
• Interfering with or disrupting the service
• Using the service to spam, harass, or abuse others
• Creating workflows that generate harmful, illegal, or abusive content
• Exceeding rate limits or abusing API quotas
• Reselling or redistributing our service without authorization

Subscription and Payment

Usage Limits and Quotas

Each pricing tier includes specific usage limits (API calls, workflow executions, storage, etc.). Exceeding these limits may result in:

• Temporary suspension of workflow execution
• Additional charges for overage usage
• Requirement to upgrade to a higher tier

We will make reasonable efforts to notify you before enforcing limits, but we are not liable for any consequences resulting from quota exhaustion.

Intellectual Property

Third-Party Services

DigiProgress integrates with third-party services including:

• LLM providers (OpenAI, Anthropic, etc.)
• Authentication services (Clerk)
• Cloud infrastructure providers

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for third-party service availability, pricing changes, or policy modifications.

Service Availability

While we strive to provide reliable service, we do not guarantee uninterrupted availability. The service is provided "as is" without warranties of any kind. We may:

• Perform scheduled maintenance with advance notice
• Experience unexpected downtime or technical issues
• Modify or discontinue features with reasonable notice
• Suspend service for security or abuse concerns

Limitation of Liability

To the maximum extent permitted by law, DigiProgress shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Service interruptions or data loss
• Third-party actions or service failures
• Content generated by your workflows

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless DigiProgress from any claims, damages, or expenses (including legal fees) arising from:

• Your use of the service
• Violation of these terms
• Infringement of third-party rights
• Content generated by your workflows

Data Backup and Export

While we maintain backups of our systems, you are responsible for maintaining your own backups of critical workflow configurations. We provide export functionality to download your workflow data, and we encourage you to use it regularly.

Termination

We may suspend or terminate your account if you:

• Violate these Terms of Service
• Fail to pay subscription fees
• Engage in fraudulent or abusive activity
• Pose a security risk to our systems

Upon termination, you will have 30 days to export your data before it is permanently deleted.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the jurisdiction in which DigiProgress operates, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration or in the courts of that jurisdiction.

Changes to Terms

We may update these Terms of Service from time to time. Significant changes will be communicated via email or through the platform. Continued use of the service after changes take effect constitutes acceptance of the modified terms.
